Hi,
I have applied for a duplicate passport 4 weeks back because my passport was damaged. I am trying to call consulate office for the status. But they said that they do not provide any status inquiry. I urgently need passport as i have to go back to india ASAP. is there any way to know the current status and speed up the delivery of duplicate passport? Normally how long it takes to get a duplicate passport.
Please help me, I will highly appreciate your help.
Thanks,
Sambhaji

Immigration Lawyers Blog Has Just Posted the Following:
On Aug. 13, 2010, President Obama signed into law Public Law 111-230, which requires the submission of an additional $2000 for certain H-1B petitions and $2250 for certain L-1 petitions. Those who are subject to the additional fees include petitioners who employ 50 or more U.S. employees and more than 50 percent of its U.S. employees are in H-1B or L status (including L-1A, L-1B and L-2). For example, ABC company has 60 employees and has 35 employees in H-1B and L-1 status. ABC Company would be required to pay the additional fee for all new H-1B and L-1 petition filings. Extension of status petitions are not subject to the additional fee. The new fees are effective immediately, applying to all petitions submitted on or after Aug. 14, 2010 through Sept. 20, 2014.

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
2. I apply for the AOS later but before her AOS approved.
My wife case (h4)
1. Apply for the AOS but do not use EAD
2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.
Shaji.

The cover of today's New York Times tells the extraordinary story of Cuban-born artist Carmen Herrera who has worked as an artist for decades and is finally enjoying real success. She's one of the hottest artists in New York and her paintings regularly sell for $30,000+. Her work is on display at the Museum of Modern Art and her work is now touring in England. Ms. Herrera moved to Paris with her American husband for a few years after World War II and then moved to the US where she embarked on her long career. About five years ago, her...

[Blogger's Note: Today's guest posting on immigration dysfunctionality offers a view on pop culture. The parenthetical "(REALLY!?!)" in the title -- inserted as an editorial comment by the blog's usual author -- suggests the smarmy skepticism of an Amy Poehler and Seth Meyers riff on Saturday Night Live. The Haloween-themed guest post is by Nici Kersey, my colleague at Seyfarth Shaw LLP and a rising star in the immigration-lawyer firmament.] For Halloween, I have decided to dress as Max from Where the Wild Things Are. I was not able to locate a Max costume at any of the traditional Halloween...

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. This means that the agency has received 700 more H-1B petitions than it can approve. Why then is the USCIS still accepting H-1B petitions? Because some of the petitions that...

The requirements depend on the International Student Office. They will give the best answer.
In my case, they required a letter from Deptt. I don't remember the contents of the letter.

This is purely my opinion and may not be the best legal advice. If I were in the same situation, I would go by the EB type (EB2 first) and then by the priority dates. Whichever one is higher, I would apply both in that classification. If both I-140's are EB3 and same priority dates, I would go with the one with better job security (stable employer and job) and keep the other I-140 as backup. In this day and age of corporate acquisitions, mergers and bankruptcies and USCIS backlogs, you want to use the option with the least risk.

Do you know how long it takes for the SWA order to be posted after a job order has been requested with the SWA?
Is it immediate or does it take some time for the SWA to process the job order and then post it?
Also do you know where we can see the job order after it has been posted? Is there a public site where we can see the jobs?
Any response is greatly appreciated, especially if you know about mass.

Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

My attorney filed I-140 on July 5th. No receipt yet. No news also.
He said he cannot send it to TSC, instead he mailed it to NSC. Is that the standard filing place?
Do you have a notice for your standalone I-140 filed at NSC on or after July5th.
